Overview

Green Peaks Capital, LLC (“Green Peaks Capital,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect through greenpeakscapital.com (the “Site”), how we use and share it, how long we keep it, and the choices and rights you have. It applies to information collected through the Site and does not apply to third-party websites we link to.

By using the Site or submitting information to us, you agree to this Privacy Policy. If you do not agree, please do not use the Site.

Information You Provide to Us

We collect information you choose to give us, including when you:

• Contact form — your name, email address, phone number, and the subject and content of your message.
• Newsletter or “learn more” sign-up — your name and email address, so we can send information you request and updates you opt into.
• Broker or deal submissions — your name and email address, along with the property information you choose to submit.
• Prospective investor information — if you proceed toward an investment, additional information is collected separately through official offering and subscription documents and is governed by those agreements.

Information Collected Automatically

When you visit the Site, a limited amount of information is collected automatically. We use privacy-friendly, cookieless analytics and do not use third-party advertising or cross-site tracking technologies:

• Server logs — your IP address, browser type, device information, pages viewed, and timestamps. Our hosting provider records this to operate and secure the Site and to prevent abuse (for example, rate-limiting our forms).
• Analytics — we use Vercel Web Analytics, a privacy-friendly, cookieless service, to understand aggregate Site usage such as page views, referring source, approximate region, device type, and browser. It does not set cookies, does not track you across other websites, and is not used to identify you individually.
• Cookies — we use only essential, functional cookies needed to keep you signed in to the admin portal. We do not use advertising, analytics, or cross-site tracking cookies. You can control cookies through your browser settings, but disabling essential cookies may prevent you from signing in.

How We Use Your Information

• Respond to your inquiries and provide the information or materials you request.
• Send you market commentary, educational content, and investor updates that you have opted into.
• Review and evaluate property and deal submissions from brokers.
• Operate, maintain, secure, and improve the Site.
• Establish and document a relationship with prospective investors as required by applicable securities laws before any investment opportunity is discussed.
• Comply with our legal, tax, and recordkeeping obligations, and enforce our terms.

Marketing Emails and Your Choices

We send marketing and informational emails only to people who have opted in. Every marketing email includes an unsubscribe link, and you can opt out at any time; we honor opt-out requests promptly.

Transactional and relationship messages — such as replies to your inquiry, confirmations, and account or security notices — are not marketing messages and may still be sent to you. Consistent with the CAN-SPAM Act, our commercial emails identify us and include a valid physical mailing address.

How We Share Your Information

We do not sell or rent your personal information, and we do not share it for cross-context behavioral advertising. We share information only as follows:

• Service providers — vendors that process information on our behalf under contract and only to provide services to us: website hosting and privacy-friendly analytics (Vercel), database and authentication (Supabase), email delivery (Resend), and email/workflow automation (Inngest).
• Legal and protection — when we believe disclosure is required by law, regulation, subpoena, or legal process, or is necessary to protect the rights, safety, or property of Green Peaks Capital, our investors, or others.
• Business transfers — in connection with a merger, financing, acquisition, or sale of assets, information may be transferred as part of that transaction.

Data Retention

We keep personal information for as long as needed to fulfill the purposes described in this policy, to maintain our relationships and business records, and to satisfy legal, tax, and securities recordkeeping obligations. When information is no longer needed, we delete or de-identify it. You may request deletion as described below.

Data Security

We use reasonable administrative and technical safeguards designed to protect your information, including encryption in transit, access controls, and hashed storage of passwords. No method of transmission over the internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security.

Your Privacy Rights

Depending on where you live, you may have rights to access the personal information we hold about you, request that we correct or delete it, and opt out of marketing communications. To exercise any of these rights, email us at the address below. We will verify your request and respond within the time required by applicable law. We will not discriminate against you for exercising your rights.

California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended (CCPA/CPRA), gives you the right to: know the categories and specific pieces of personal information we have collected; request correction of inaccurate information; request deletion of your information; and opt out of the “sale” or “sharing” of personal information. We do not sell or share personal information as those terms are defined under California law, so there is no opt-out needed.

The categories of personal information we collect are: identifiers (such as name, email address, phone number, and IP address); internet or network activity (such as Site usage); and commercial information (such as deal submissions). We collect this information for the business purposes described above and retain it as described in “Data Retention.”

Do Not Track and Global Privacy Control

Because we do not track you across other websites or serve targeted advertising, we treat all visitors consistently and do not currently respond differently to “Do Not Track” browser signals.

The Site may contain links to third-party websites, such as market research or news sources. We are not responsible for the privacy practices of those sites, and this policy does not apply to them. We encourage you to review their privacy policies.

Children's Privacy

The Site is intended for adults, and any investment opportunities are available only to qualified investors. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with information, please contact us and we will delete it.

Any investment is offered solely through official offering documents (including a private placement memorandum) and only to qualified investors with whom a pre-existing relationship exists.
